Terms of Service

1. Who we are and accepting these terms

TopArab.casino is operated by H. Abu Hichmeh, based in Canada ("we", "us"). These terms form an agreement between us and the business that creates an account on our platform ("you" or the "tenant"). Tenants are iGaming affiliates and casino operators.

By creating an account, starting a free trial or paying for a plan, you confirm that you accept these terms and that you have the authority to accept them for your business. If you do not agree, do not use the service.

2. The service

We provide a subscription software service: a free-to-play blackjack tournament that runs through your own Telegram bot and on a web table hosted at blackjack.toparab.casino, together with a dashboard to set it up and run it. The game uses virtual chips only. Players never deposit, wager or win money inside the game. Prizes, when you offer them, are a bonus balance at a sponsoring casino and are handled outside our platform. You can read a full description on our how it works and features pages.

One subscription covers one tenant: one bot, its public channel, its private staff group and its web table.

3. Your account and your responsibilities

You must give accurate account details and keep your login credentials private. You are responsible for everything done through your account. As a tenant, you also agree that:

• You create and run your own Telegram bot, public channel and private staff group, and you control who has access to them.
• You keep the 21+ age confirmation switched on and you do not target or knowingly admit anyone under 21.
• You follow the laws and advertising rules of every country you target, as well as the rules of Telegram and of any ad network you use. We do not give legal advice and we do not check your campaigns for you.
• You do not use the game for real-money wagering, you do not sell, buy or exchange chips, and you do not present chips as having any cash value.
• You alone are responsible for any prize that you or your casino partner promises, for describing it accurately and for crediting it to winners. We are not a party to any prize arrangement.
• You keep your bot token safe. If you think it has been exposed, revoke it in BotFather and update it in your dashboard straight away.

4. Free trial and plans

New tenants get a free trial of 3 months. After the trial, you can continue on a paid plan: 20 USDT per month or 200 USDT per year. Current prices are always shown on our pricing page. If we change prices, the new price applies from your next paid period, never to a period you have already paid for.

5. Payment

Plans are paid in USDT on the TRC-20 or ERC-20 network through our payment page. Your plan is activated after we confirm that the payment has arrived. Network fees are paid by the sender. Please check the network and the address before you send: a payment sent on the wrong network or to the wrong address may be lost, and we cannot recover it. Full details are in our billing policy.

6. Renewal

Renewal is manual. Because payments are crypto transfers that you send yourself, we cannot and do not charge you automatically. To keep your service running, you send the payment for the next period before the current one ends. We send reminders before your trial or paid period ends.

7. Cancellation and refunds

You can cancel at any time by not renewing, or by telling us by email. Your account stays active until the end of the period you have paid for. Paid periods are not refunded, in whole or in part, including when you stop using the service early.

8. Suspension and termination

We may suspend your tenant if a paid period ends without renewal, or if you breach these terms or our responsible use policy. Where it is reasonable, we will contact you first and give you a chance to fix the problem. For serious breaches, for example real-money use of the game, targeting minors or spam, we may suspend at once and may terminate your account. A suspension or termination for breach does not entitle you to a refund.

9. Acceptable use

You must not use the service to break the law, to send spam, to mislead players, to attack or overload our systems, to copy or reverse engineer the platform, or to resell access to it without our written agreement. The detailed rules for running tournaments and promotions are in our responsible use policy, which forms part of these terms.

10. Intellectual property

The platform, including its software, game, designs, dashboard and documentation, belongs to us. Your subscription gives you a limited, non-exclusive, non-transferable right to use it for your own tenant while your account is active.

You keep all rights in your own logos, names, texts, images and other content you upload. You give us a licence to store, display and send that content, only as needed to run your tenant, for example to show your sponsor logo on the table or post your leaderboard to your channel.

11. Availability and maintenance

We work to keep the service available and running well, on a best effort basis. We do not promise uninterrupted or error-free service. We may carry out maintenance and updates, and when planned work is likely to affect players we will try to tell you in advance. Telegram is a third-party platform; we are not responsible for its outages or rule changes.

12. Data

How we handle personal data from website visitors, tenants and players is explained in our privacy policy. For player data, we process it on your behalf, and you are responsible to your players for how you use their data, including winners' emails shared in your staff group.

13. Disclaimers and limitation of liability

The service is provided "as is" and "as available". To the extent the law allows, we do not give any warranty that it will meet your business goals or produce any particular number of players, sign-ups or deposits.

To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, lost revenue, lost data or reputational harm, or for losses caused by Telegram, by your casino partner, or by payments sent to a wrong network or address. Our total liability for all claims connected with the service is limited to the fees you paid us in the 12 months before the event that gave rise to the claim. Nothing in these terms limits liability that cannot be limited by law.

14. Indemnity

You agree to compensate us for claims, losses and reasonable costs, including legal fees, that arise from your breach of these terms, from the content or promotions you run, from prizes you or your casino partner promise, or from your failure to follow the laws of the countries you target.

15. Changes to these terms

We may update these terms from time to time. The date at the top of this page shows the latest version. If a change materially affects you, we will tell you by email or in the dashboard before it takes effect. If you keep using the service after that date, the updated terms apply.

16. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have jurisdiction over any dispute about these terms or the service.
